(Cap 84, section 21) [20 October 1972] (L.N. 174 of 1971) Cap 84A reg 1 Citation These regulations may be cited as the Pilotage Regulations. Cap 84A reg 2 Application for registration as an apprentice pilot (1) An application for registration as an apprentice pilot shall be made in such form as the Authority may determine, and shall contain the particulars required thereby. (2) On receipt of an application in accordance with paragraph (1) for registration as an apprentice pilot, the Authority shall, if he is satisfied that the applicant possesses the prescribed qualifications and experience, refer the application to the Committee, which shall interview the applicant. (3) On payment of the prescribed fee, the Authority shall cause the applicant to be examined as to his physical and mental fitness and his eyesight in accordance with section 7(1)(b) and (c) of the Ordinance as if the applicant were applying for a licence. (4) The Committee shall, after interviewing the applicant in accordance with paragraph (2), report to the Authority whether or not it considers that the applicant ought to be registered as an apprentice pilot. (5) If- (a) the Authority is satisfied as to the applicant's physical and mental fitness and eyesight; and (b) the Committee has reported that it considers the applicant ought to be registered as an apprentice pilot,the Authority shall- (i) enter the name and particulars of the applicant in a register of apprentice pilots maintained by him; and (ii) notify the applicant in writing of his registration as an apprentice pilot and issue to him an identity book in such form as the Authority may determine. Cap 84A reg 3 Application for licence An application for a licence shall be- (a) made in such form as the Authority may determine and shall contain the particulars required thereby; and (b) accompanied by such photographs of the applicant as the Authority may require. Cap 84A reg 4 Application for renewal of licence An application for the renewal of a licence shall be in such form as the Authority may determine, and shall contain the particulars required thereby. Cap 84A reg 5 Authority may require production of further photographs of licensed pilot If at any time it appears to the Authority that the photograph attached to a licence is no longer an adequate likeness of the holder of the licence, the Authority may require the licensed pilot to furnish 2 photographs of himself. Cap 84A reg 6 Prescribed fees (1) The fee payable under section 7(1)(a), (b) and (c) inclusive of the Ordinance shall be- (a) $12700 for a Class I licence; and (b) $4890 for a Class IID licence. (L.N. 337 of 1993; L.N. 358 of 1996)(1A) The fee payable under section 7(1)(a) only of the Ordinance shall be- (a) $12100 for a Class I licence; and (b) $4290 for a Class IID licence. (3) The fee payable under section 9(2)(b) of the Ordinance on the renewal of a licence shall be $110. (4) The fee payable under section 9(3) of the Ordinance on the issue of a copy of a licence shall be $110. (4A) The fee payable under section 9A(2) of the Ordinance on the issue or renewal of a licence shall be $110. (L.N. 337 of 1993) (L.N. 124 of 1985; L.N. 162 of 1987; L.N. 311 of 1989; L.N. 251 of 1992; L.N. 275 of 1995) Cap 84A reg 7 Pilots to display flag when plying for hire Every licensed pilot shall, when plying for hire, display at the masthead of his vessel a flag 1.8 metres by 1.2 metres in size and of 2 colours, the upper horizontal half thereof being white and the lower horizontal half thereof being red. (L.N. 375 of 1984) Cap 84A reg 8 Power of Authority to give directions Remarks: Adaptation amendments retroactively made - see 64 of 1999 s. 3 (1) The Authority may give to a licensed pilot such directions as he considers necessary for the regulation of shipping in the waters of Hong Kong, including directions requiring a licensed pilot to perform for any ship such pilotage service as may be requested by or on behalf of the master or owner of the ship. (64 of 1999 s. 3) (2) It shall be the duty of a licensed pilot to comply with any directions given under paragraph (1). Cap 84A reg 9 Duty of pilot to report hazards to shipping Remarks: Adaptation amendments retroactively made - see 64 of 1999 s. 3 If a licensed pilot knows of- (a) any defect in a navigational aid in the waters of Hong Kong; (64 of 1999 s. 3) (b) any other hazard to shipping therein; or (c) any alteration of the position of a harbour buoy,he shall report the same to the Authority forthwith, by radiotelephone if practicable. |
